Article 1 – Applicability

1. These general terms and conditions apply to all offers, products, services, and agreements between By Dee Academy (hereinafter: “the entrepreneur” ) and a consumer (hereinafter: “the customer” ).
2. By making a purchase or registering for a service, the customer agrees to these general terms and conditions.

Article 2 – Offer and products

1. By Dee Academy offers online training, digital tools, and coaching programs via digital platforms, including WordPress and Mighty.
2. The offer is described as fully and accurately as possible on the website. Obvious mistakes or errors in the offer do not bind the entrepreneur.
3. All products are intended for personal use and may not be shared, copied, or resold without written permission from By Dee Academy.

Article 3 – Formation of the agreement

1. The agreement is concluded as soon as the customer has placed an order and the payment (or first installment) has been received.
2. After payment, the customer receives access to the purchased product or program via the platform used by By Dee Academy.

Article 4 – Payment

1. Payment is made in advance via the offered payment methods.
2. Payment in installments is possible if this is explicitly stated in the offer.
3. The client is obliged to meet the agreed installments. Late payment may result in the suspension of access to the program or course.

Article 5 – Right of withdrawal and cancellation

1. Consumers are subject to a statutory cooling-off period of 14 days for online purchases.
2. If the customer gains access to digital content (such as an online training or tool) within this period and has used this access, the right of withdrawal lapses.
3. Cancellation of a coaching appointment must take place at least 24 hours before the start time.
4. If the customer fails to appear without a valid reason or does not cancel in time, a fine of €89 will be charged.

Article 6 – Modification or cancellation by By Dee Academy

1. In the event of illness or force majeure, By Dee Academy reserves the right to reschedule appointments, training courses, or sessions.
2. The customer will be informed of this as soon as possible.

Article 7 – Liability

1. By Dee Academy guides clients in the areas of personal development and mindset, but does not provide medical, psychological, or therapeutic care.
2. Participation in programs, training courses, or coaching trajectories is at the client’s own responsibility.
3. By Dee Academy is not liable for direct or indirect damage resulting from decisions or actions taken by the customer based on the information provided.
4. The total liability of By Dee Academy is in all cases limited to the amount the customer has paid for the relevant service.

Article 8 – Intellectual property

1. All materials, texts, audios, videos, tools, and other content offered via By Dee Academy remain the property of By Dee Academy.
2. It is not permitted to share, distribute, or use content for commercial purposes without permission.

Article 9 – Force Majeure

1. By Dee Academy is not obliged to fulfill any obligation if it is prevented from doing so by force majeure, such as illness, internet outages, technical problems, or other circumstances beyond its control.

Article 10 – Complaints and disputes

1. Any complaints must be reported in writing within 7 days of their occurrence via welkom@bydeeacademy.nl.
2. By Dee Academy will handle complaints carefully and provide a substantive response within 14 days.
3. Dutch law applies to all agreements.
4. Disputes may be submitted to the competent court in the district of Rotterdam.

Article 11 – Amendments to the terms and conditions

1. By Dee Academy reserves the right to amend these general terms and conditions.
2. The most recent version can always be found at www.bydeeacademy.com and is valid from the moment of publication.
